As Debt Collection & Insolvency Lawyers, this area of our practise can often overlap with the work undertaken in our Civil Litigation department. You may have obtained a judgment against a person or company and now require that it be enforced. Alternately, a person or company may owe you money and we will need to commence debt collection proceedings afresh.We will generally
- Make demands for payment of your outstanding debt
- Resort to litigation if the demand is not met.
There are many ways in which we may assist you in recovering monies owing to you. We will assist you in selecting the appropriate method of enforcement and we may recommend that a report be prepared into the debtor's assets and liabilities and accordingly their ability to pay the debt.
Litigation may be commenced against an individual, a company or several parties at once if required. Ultimately, if the matter is not defended, or if you are able to prove your case, a judgment will be obtained.
There are several methods of enforcement then available to you. We can assist you with any of the following:
- Obtaining an Instalment Order;
- Summons to Attend for Oral Examination;
- Warrant to Seize Property (goods and/or land);
- Attachment of Earnings Order;
- Attachment of Debts Order (Garnishee Order);
- Bankruptcy (individuals); and
- Winding Up (companies).
